1. Independent Practice.
The Practitioner acknowledges that they are operating as an independent professional and not as an employee, agent, or representative of Just Bee Hawaii LLC. The Practitioner is solely
responsible for all aspects of their practice, including treatment methods, client relationships, and professional compliance.
2. Professional Qualifications.
The Practitioner represents and warrants that they are duly licensed, certified, or otherwise qualified under applicable laws and regulations to provide the holistic therapies and services they offer. The Practitioner shall maintain all required professional licenses, certifications, and registrations in good standing at all times.
3. Insurance.
The Practitioner shall, at their own expense, maintain professional liability (malpractice) insurance and general liability insurance and shall provide Just Bee Hawaii LLC with certificates of insurance upon request.
4. Indemnification.
The Practitioner shall indemnify, defend, and hold harmless Just Bee Hawaii LLC, its owners, officers, employees, agents, successors, and assigns (“Indemnified Parties”) from and against any and all claims, demands, causes of action, damages, liabilities, judgments, losses, costs, and expenses (including reasonable attorneys’ fees), arising out of or related to:
(a) any service, treatment, therapy, or advice provided by the Practitioner;
(b) any injury, illness, or adverse outcome experienced by a client or third party in
connection with the Practitioner’s services;
(c) the Practitioner’s breach of any applicable law, regulation, or professional standard; or
(d) the Practitioner’s breach of this Agreement.
This indemnification shall survive the termination of this Agreement and the Practitioner’s use of the Premises.
5. Client Waivers.
The Practitioner shall obtain signed waivers or informed consent forms from each client receiving services, acknowledging the nature of the holistic therapies and releasing Just Bee Hawaii LLC from liability related to such services. Copies of such waivers shall be maintained by the Practitioner and made available to Just Bee Hawaii LLC upon reasonable
request.
